A federal jury awarded $18.6 million to a 54-year-old Truck Driver from Canada, who was killed in the early morning hours of August 10, 2014 on I-80 in central Illinois when another tractor-trailer, driven by defendant Dung Nguyen, working for his own trucking company, Antioch Transport, Inc., fell asleep, crossed over into the oncoming lanes of I-80 in the dark, woke up and then drove into the oncoming lanes of travel and attempted a U-turn blocking all Westbound lanes of travel.
The decedent, Alex Volkov, was operating his tractor trailer in the westbound lanes and was caused to unavoidably crash into the Antioch Truck. Volkov was seriously injured and experienced significant pain and suffering prior to his death 48 minutes later, all while trapped in his truck following the crash.
The federal jury rendered their verdict against not only the other driver and his company but also found against the freight broker, C.H. Robinson Worldwide, Inc. that had placed the load with the driver because of the level of control they had over his work. The jury found the driver to be the legal agent of C.H. Robinson Worldwide making them legally responsible for the crash.
Attorney Christopher M. Norem of Parente & Norem, P.C. stated, “This is a significant finding because C.H. Robinson Worldwide is one of the largest freight transportation services companies and third-party logistics providers in North America. They are putting thousands of supposed “independent contractor” drivers like Dung Nguyen on our highways every day, controlling all of their conduct, and when one of them negligently kills someone they immediately claim they are “Independent contractors” so they have no legal responsibility for them. The jury strongly rejected this claim by entering this verdict.”
The decedent driver, Alex Volkov, lived in a suburb outside of Toronto and is survived by his wife, Natalia Volkova, and his two daughters, Julia Volkova and Victoria Volkova.
