U.S. District Court Judge Allison Burroughs in Boston rules that prosecutors failed to prove Insys violated the Controlled Substances Act.
The defendants in this case were Insys Therapeutics founder John Kapoor and former executives Michael Gurry, Richard Simon, Sunrise Lee and Joseph Rowan, still stand.
In her decision, she explained that the government failed to prove the defendants intended to commit bribery and extortion, meaning the earlier convictions were to be thrown out.
Judge Burroughs denied Kapoor’s request for a new trial, and the defendants are scheduled for sentencing in Janurary 2020.
