Man acquitted of murder in 1980s pleads guilty to 2018 voluntary manslaughter

A 66-year-old Buckhannon man acquitted of murder and malicious assault nearly 40 years ago when the state failed to prove he was sane pleaded guilty to voluntary manslaughter Thursday in the March 8, 2018, homicide of his father.

The plea by Timothy Allen McWilliams was an Alford plea, meaning that Upshur County Prosecuting Attorney David Godwin gave the factual basis instead of the defendant.

McWilliams told the court he was entering the plea to avoid the possibility of a greater sentence should he go to trial and be convicted of murder or second-degree murder.
