$5 Million Settlement For Wrongful Death
Joey Roscitt was employed as a union electrician and was working at Chefler Foods on behalf of his employer. On the date of the accident, Joey was using a scissor lift to change lightbulbs on the production floor. As Joey was working, a forklift reversed into the scissor lift he was working on knocking it over. This caused Joey to fall approximately 30 feet to the ground and hit his head on the concrete floor causing him serious injuries that led to his death. Joey was 46 years old at the time of the accident, was not married, and had no children.
Joey suffered, amongst other injuries, a traumatic brain injury. A CT scan of Joey’s head showed a fracture deformity, as well as probable hemorrhagic shearing injury, bilateral frontal contusions, left temporal contusion, and pontine hemorrhage due to shear injury. He underwent left decompressive hemicraniectomy on December 3, 2021. Because of that the left side of his head was sunken in.
After the accident, Joey was admitted to Kessler Rehabilitation (“Kessler”). Joey was at Kessler from December 1, 2021 until his death on June 22, 2022. Joey had to be transferred multiple times to the hospital for various medical episodes. Essentially, Joey was trapped in his body unable to control his movements. Joey was non-verbal but would respond to voices and sounds. He was able to smile and would acknowledge the people around him.
The case was mediated with retired judge Maurice J. Gallipoli.
