Arkansas Women Sue State to Overturn State’s Ban on Abortion

A group of Arkansas women, represented by the group “Abortion in America”, is suing to overturn the state’s bans on abortion, the most significant of which—the Arkansas Human Life Protection Act—went into effect immediately after Roe v. Wade was overturned in 2022.
In the lawsuit, which was filed in Pulaski County Circuit Court on Wednesday, plaintiffs claim that:
- The abortion bans are unconstitutionally vague and violate physicians’ right to due process as guaranteed by Article 2, Section 8 of the Arkansas Constitution;
- The bans unconstitutionally prohibit pregnant Arkansans from exercising the inherent and inalienable rights to life, liberty, and the pursuit of happiness;2
- And the bans discriminate against pregnant Arkansans and violate their constitutional rights to equality.
