Cop Sues Police Department for Allegedly Being Discriminated Against, Reassigned After Absence Due to Illnesses

An Asbury Park police officer has sued the department alleging he was racially discriminated against, subjected to a hostile work environment and transferred back to a unit he’d been promoted out of almost 15 years earlier after he missed months of work due to multiple heath problems, and later complaining about mold in the department’s headquarters.

In a lawsuit filed in Monmouth County, Kirby Vargas said his he was re-assigned to the traffic unit in January after he previously missed months of work in 2021 due to COVID and cancer before getting sick the following year due to mold in police headquarters.

Vargas also alleges he was discriminated against and retaliated against in part because is Latino. He had earlier filed a workers compensation claim after testing positive for the coronavirus in March 2021 and being diagnosed with cancer two months later.
