Car Accident Results in $1.7 Million Settlement for the Plaintiff

James P. Kimball, of Seigel Law LLC, represented plaintiff, a 60 year-old male from Latham, New York, that was the driver of a GMC Yukon on April 23, 2018 on Teaneck Road at DeGraw Avenue in Teaneck, New Jersey. He was stopped at the traffic light and was going to be making a left turn onto DeGraw. A tractor trailer owned by Maxim Crane Work, L.P., and being operated by David G. Hegland, was also stopped for the red traffic light in a lane to the right of the plaintiff. Both lanes were left turn lanes to go onto DeGraw Avenue. As the light changed green, both vehicles moved forward and began their left runs, Mr. Hegland’s trailer struck the passenger side of the plaintiff’s vehicle.

The plaintiff was seen in the ER of Holy Name Hospital with complaints of neck pain. He began physical therapy for neck and back pain. MRI’s revealed multiple disc bulges in the cervical spine and disc herniations at C5-6 and C6-7. MRI of the lumbar spine revealed multiple disc bulges in the lumbar spine and a disc herniation at L4-5.

After conservative care and pain management treatment failed to resolve the plaintiff’s symptoms, the plaintiff underwent anterior cervical discectomy and fusion at C5-6, C6-7 and C7-T1. Additionally, the plaintiff underwent lumbar fusion at L4-5 and L5-S1.

The defendants presented medical and biomechanical experts disputing that the accident caused the injuries and need for surgeries.

The matter was settled pending trial after the case had been mediated by Raymond Reddin, J.S.C. (retired). The plaintiff received a $1,700,000 settlement for this accident.
