Discrimination Lawsuit Against Workday’s AI Job Screening Application Grows Bigger, May be Transformed into Collective Action Litigation

Business owners who have already adopted artificial intelligence to assist with their hiring and other personnel work—and those thinking about doing so—should keep an eye on a broadening lawsuit targeting the software firm Workday. The outcome of the case alleging Workday’s AI application repeatedly discriminated against certain kinds of job applicants will set a precedent defining the legal risks companies could face when using the technology.

This week, Judge Rita Lin ruled in San Francisco Federal Court that a 2023 case filed by a single plaintiff claiming Workday’s tech caused over 100 of his job applications to be rejected due to his age, race, and disabilities may now be transformed into collective action litigation.
