éclat Law Obtains Settlement for Americans with Disabilities Act Violations
(Altamonte Springs, FL), June 16, 2022 Kevin K. Ross-Andino, senior civil trial attorney and founder partner of éclat Law, LLP announced that the firm recently obtained a settlement on behalf of its clients against defendants, Osceola County and an Osceola County Battalion Chief, for Intentional Infliction of Emotional Distress (IIED) and for Violations of the Americans with Disabilities Act (ADA), overcoming the sovereign immunity challenged typical of bring lawsuits against governmental entities.

The court records show that in 2016, service units from Osceola County Fire and Rescue were dispatched to the plaintiffs’ home after receiving a 911 call reporting a residential fire. While the plaintiffs were not present at the time, their four pets, including an emotional support animal, were inside the home. The Battalion Chief for Osceola County Fire and Rescue, who was acquainted with the plaintiffs, responded to the call, and took command of the situation. During an internal investigation, it was reported that minimal efforts were used to extinguish the fire while also making derogatory comments about the plaintiffs to other onsite firefighters.
In 2020, the plaintiffs sued the Battalion Chief for IIED and Osceola County for Violations of the ADA. The case was settled in March 2022 in the United States District Court, Middle District of Florida, Orlando Division.
