El Salvadoran Immigrant is Awarded $965,000 After Sustaining Injuries from Falling Off a Roof

Jury verdict was won in Berkshire Superior Court for El Salvadoran immigrant who fell from roof injuring ankle and foot while working for defendant who did not carry workers compensation insurance in violation of M.G.L.c. 152. Jury verdict June 2017 resulting in judgment of $965,000.00. Defendant filed for bankruptcy protection, and plaintiff pursued an adversary action in bankruptcy court Massachusetts Western Division. Def, who for 25 years was owner of landscaping and property maintenance business and who was owner of multiple rental units, was denied discharge under 11 U.S.C. sec 727 (a)(3) and (a) (4) for his failure to keep adequate business records without justification and failure to disclose real property and brokerage account. Bankruptcy Appellate panel affirmed the denial under sec 727(a)(3). U.S.C.A 1st Circuit affirmed denial of discharge. The plaintiff was represented by Cynthia A. Spinola, of Hashim and Spinola.
