Foul Ball that Led to Permanent Eye Damage Ends in a $1 Million Settlement

Plantiff suffered a permanent eye injury as a result of being stuck by a foul ball while she was a spectator at a college baseball game. An appellant decision rejected the hundred year old “Baseball Rule”( which absolved any liability for foul ball injuries which occurred during baseball games) in allowing Thomas Michael Dempsey, of Dempsey Law Firm,  to proceed with the case. The result has been cited more than 60 times on Westlaw and discussed in several publications, including the Los Angeles Times, Ballpark Digest and a Sports Illustrated Article entitled “Crying Foul Over Ballpark Injuries”. Because of the difficulties in prosecuting this matter, litigation lasted for seven(7) years. This incident did result in a $1 million settlement.
