State Appellate Court Overturned Verdict Convicting Man of Murdering Parents

STATEN ISLAND, N.Y. — In a stunning reversal, a state appellate court on Wednesday overturned the verdict convicting an Annadale man of murdering his parents 10 years ago.

The Appellate Division, Second Department, ruled the trial judge should have granted defense and prosecution requests for an additional mental exam of Eric Bellucci, a diagnosed paranoid schizophrenic, prior to trial.

“Under the circumstances, when confronted with evidence that the defendant was not taking his required medication and was not able to communicate rationally with his attorney, the Supreme Court should have granted the joint applications of the People and the defense to have the defendant examined … to determine his fitness to proceed,” the appellate court said in a unanimous four-member ruling.
