Child Left Permanently Paralyzed After X-Ray Oversight, Receives Settlement of $40,350,000

Chad McGowan, of McGowan, Hood, and Felder, LLC, represented a child in a Medical Malpractice case involving a missed finding on newborn’s x-rays. The radiologists, who were not pediatric specialists, spent on average less than 60 seconds reading and reporting on the x-rays at issue. All radiologists missed an obvious abnormality which if investigated, would have led to the discovery and treatment for a tumor. The tumor was a childhood cancer known as neuroblastoma, which is completely treatable. The delay in diagnosis, however, allowed the cancer to grow in and around the baby’s spinal cord leading to permanent paralysis. This case resulted in a $40,350,000 settlement.
