Driver That Was Rear-Ended By FedEx Driver Awarded $8 Million
A FedEx driver was not paying attention and failed to see that traffic ahead was slowing down. As a result of this poor decision, he smashed the rear of a vehicle, causing the driver to facet injuries which required ongoing pain management procedures (rhizotomies). The defense hired Howard Tung, M.D. out of California who tried to claim that a subsequent crash 5 months later was the ultimate cause of all of the victim’s problems and that the victim had fully resolved from the FedEx crash. He also argued that because the E.R. doctor found zero objective or subjective complaints/symptoms after the FedEx crash that the victim was not really hurt at all.
The victim of this accident was represented by Benjamin Cloward, of Cloward Trial Lawyers. With the help of Mr. Cloward, the victim was award $8 Million in a verdict.
