Victim of Medical Malpractice is Awarded $1.66 Million by Jury

Michael Davis, 42, is a long-distance truck driver. Mr. Davis saw very few doctors in his life and was very healthy until he began to establish care at Mercy Medical Center in Williston, ND. From 2016 through 2018, Mr. Davis sought treatment at Mercy Medical Center at least 17 times.

During that time, the providers at Mercy Medical Center did not recognize Mr. Davis’s high protein urinalyses, follow up with repeat urinalyses, or communicate with each other, or with Mr. Davis regarding his symptoms and condition. The providers also failed to timely refer Mr. Davis to a nephrologist when they had clear evidence of abnormal kidney function.

As a result, Mr. Davis’s kidney continued to deteriorate. In 2018, by the time Mr. Davis received medical treatment at Mayo Clinic, his kidney was beyond repair and resulted in end-stage renal disease. Had Mr. Davis been appropriately and timely treated, his kidney disease could have been successfully treated preventing the deterioration of his kidney.

Mr. Davis sued the nurse practitioner, medical doctor, and their employer Mercy Medical Center alleging failure to property diagnose and treat Mr. Davis’s kidney disease and timely refer him to a nephrologist.
The jury awarded $1.66 million
