Liberty University Sued by Founder’s Family Trust for Alleged Trademark Infringement

Jerry Falwell, Jr. announced on Friday that Liberty University is being sued by the Dr. Jerry L. Falwell Family Trust, alleging the university has exploited Dr. Falwell’s trademarked name and image.

After Dr. Falwell’s passing in 2007, he left his intellectual property in the Trust for the benefit of his children; of which Jerry Falwell, Jr. is a trustee and beneficiary.

The lawsuit, which was filed on Thursday, claims that Liberty has wrongfully used Dr. Falwell’s name and image, and the “Jerry Falwell” trademark. Such wrongdoing includes using them without permission or license to create a false association with the Jerry Falwell brand and the impression that the use of Dr. Falwell’s intellectual property is authorized by the Trust, which it is not.
