Parents Pursue Wrongful Death Lawsuit Against Ohio University For Ignoring Their Calls For Mental Health Wellness Check of Freshman Daughter

The parents of 2019 Ohio University freshman student Jordyn Airy, have filed a wrongful death lawsuit against Ohio University arising out of Ohio University Housing and Residence Life staff members’ gross negligence. The suit alleges that Ohio University’s residence advisor (RA) and residence director (RD), responsible for safeguarding, protecting and advising students in dormitory Wilson Hall, failed to follow and implement proper procedures, protocols and standards dealing with the mental health and wellbeing of students, including Jordyn Airy.

On September 7, 2019, just a few weeks into Jordyn’s freshman year, Jordyn’s parents, Brad and Robin Airy, had significant concerns about Jordyn’s mental health and wellbeing. Despite repeated attempts to get in touch with their daughter, they were unsuccessful. Having been informed by Ohio University throughout the entire admissions and enrollment process, that they as student parents were part of the “Bobcat Family”, maintained a special relationship with Ohio University and that parents were encouraged to reach out to school officials at any time if they felt as though their child was in crisis, Brad Airy contacted Ohio University staff. Throughout the day of September 7, Brad attempted multiple times to contact Jordyn’s RA and RD and implored them to make contact with Jordyn in her dorm room and do a mental health wellness check. For more than four hours his calls for help were ignored. It was not until after 6pm that the RA and RD decided to go into Jordyn’s room where she was found dead. Her cause of death was determined to be prescription medication intoxication.

The lawsuit filed in the Ohio Court of Claims, by Cleveland attorneys Raymond Marvar (The Marvar Law Firm) and Paul Grieco (Grieco Law) seeks in part, to require Ohio University to revise and reform its student mental health and crisis programming such that it meets and exceeds required standards of care and best practices.
