Ex-Sanitation Worker Files a Sexual Assault Lawsuit Against the City of Albany, New York

A longtime employee with Albany’s Department of General Services is suing the city alleging she endured years of sexual harassment that culminated with her being assaulted by a supervisor in 2011.

The female employee, who was a sanitation worker with the department from 1998 to 2012, alleges in the lawsuit filed recently in state Supreme Court in Albany that the male-dominated workplace resulted in her being “constantly passed over for opportunities, harassed, assaulted and abused because of her gender.” The lawsuit asserts that the city should have known about the hostile work environment and taken steps to rectify it after she reported the misconduct, including being sexually assaulted, to multiple supervisors.

The extraordinary accusations leveled against the city were filed under the Adult Survivors Act, which lifted the statute of limitations for one year in New York for survivors of sexual assault to file civil claims against their alleged abusers regardless of how long ago the incidents took place. The legislation has generated less than 200 cases, according to a recent tally by the state Office of Court Administration. Some cases were filed with multiple plaintiffs, but there have been far fewer cases than were filed under the predecessor Child Victims Act.
